Really, I just wanted an excuse to use this icon.
1. I know you all know, because it swamped my flist yesterday, but Prop 8 was declared unconstitutional on both equal justice and due process grounds by one of California's District Courts yesterday. The appeal was filed this morning, of course, but the 9th Circuit will affirm (because let's face it, it's the 9th Circuit) and then it'll go to the Supreme Court. Elena Kagan, who kicked military recruiters off Harvard Law's campus for not allowing equal opportunity to all law students because of the Don't Ask, Don't Tell policy, is going to be confirmed to the Supreme Court today. I haven't read the opinion (which I've been assured is scathing) but I'm guessing the fallout will go like this (assuming the 9th Circuit affirms): Kagan, Ginsburg, Breyer, and Sotomayor will affirm, Scalia, Roberts and Alito will vote to reverse. Justice Kennedy is the traditional swing vote - he's not terribly consistent on anything but he's been fairly open to personal liberty and gay rights, so I'm guessing he'll be the fifth vote to affirm. I am really kind of curious about what Justice Thomas might do. The only way I could imagine him affirming is if he was persuaded that Prop 8 was analogous to the law struck down in Loving v. Virginia. Which he might, but I'm leaning toward no. Anyway, apparently now people think Judge Walker should be impeached (on what charges, I have no idea) and compliments of gblvr, Fox News is running this poll. Vote early, vote often!

Also, apparently no on is allowed to spoil me for what comes after that episode, because that's where we stopped last night.
