Its slander when sophie was speaking it is there was someone there to hear it... You have since written a previous coversation... still libel. now, when it comes to hearsay, in a court of law, your "transcript of actual events" argument may matter, but not here.

good point. except, in journal world, events take place as people read them: that's called Active-Active voice.

Ok... this is the last thing I'm typing about this. There is no way your TYPING this "conversation" can be slander because this is EXACTLY what slander is:

"ORAL defamation; SPOKEN words that defame a person in front of others and that cause harm or some damage."

LIBEL: any false and malicious written publication (a posting on the internet qualifies as a publication) printed for the purpose of defaming another's character or reputation...

typing it after its said is not still speaking it. no matter how you active-active voice it or philosophize it or whatever you want to do.

But then again, I'm just a lawyer. What the hell do I know?

well, everything you say is true. unfortunately, you total missed the humorous point i was making, that in my lj-world, there is no difference between experiencing an oral conversation and reading it. yes, this is not feasible on this earth. but yes, it was a joke/existential concept. why it is so difficult for you do "get this" suggests that I am horribly unfunny, or that you are, well something, the most generous term i can think of is, "unfunny."

i just don't get smart humor cause i'm sorta dimwitted. i laugh when someone says something like, "wow, those are some spicy nuts." then i say, "hehe... nuts."
