The problem with davidenglish is that he isn't a lawyer and doesn't think like one, but he thinks he does.
Since the discussion recently while waiting the Lexicon verdict has centered on fanfiction, I have started to re think the entire concept of what is or is not fanfiction and what would or should not be allowed by copyright. I have just posted my opening thoughts on this subject on my blog. I'll be adding additional comments and thoughts on this subject when I have time. I would appreciate some thoughts from some additional lawyers, so if Bluestocking is reading this post, I would like her imput on some specifics. Non lawyer thoughts or ideas would of course be appreciated. I can see where this would be fun while we wait.
My opening to the book would be somethink that a writer would wish to do if his desire was to build on the magical world of Harry Potter by destroying the hero nature of JKR's hero and create a new hero. This new hero being created is named "Jason."

So true. Far too many posters on the LL take what davidenglish says as gospel and he clearly revels in the attention he receives. When you deconstruct his comments though all you are left with are fanciful words and no substance. He sucks up to Melissa whenever she deems to make an appearance and gets away with the nonsense he spouts.
