В конце сентября 2018 над Родом Розенштейном, заместителем генпрокурора и начальником специального прокурора Роберта Мюллера, сгущались тучи. Частично это была разводка со стороны Трампа для отвлечения внимания журналистов от дела Кавано.

According to a source briefed on Trump’s thinking, Trump decided that firing Rosenstein would knock Kavanaugh out of the news, potentially saving his nomination and Republicans’ chances for keeping the Senate. “The strategy was to try and do something really big,” the source said. The leak about Rosenstein’s resignation could have been the result, and it certainly had the desired effect of driving Kavanaugh out of the news for a few hours.

Rosenstein - who, by one account, had gotten teary-eyed just before the call in a meeting with Trump’s chief of staff - sought to defuse the volatile situation and assure the president he was on his team, according to people familiar with matter. He criticized the Times report, published in late September, and blamed it on former deputy FBI director Andrew McCabe, whose recollections formed its basis. Then he talked about special counsel Robert S. Mueller III’s investigation of Russia’s interference in the 2016 election and told the president he would make sure Trump was treated fairly, people familiar with the conversation said.
“I give the investigation credibility,” Rosenstein said, according to an administration official with knowledge of what was said during the call. “I can land the plane.”

Загадочная фраза про самолет заиграла новыми красками в свете деталей, раскрытых в новой книжке репортера Майкла Шмидта "Donald Trump v. The United States: Inside the Struggle to Stop a President".

Шмидт проливает свет на одну из старых загадок Рашагейта: Что заставило Розенштейна поторопится с назначением Мюллера в мае 2017? В это время общественное давление росло, но было еще далеко от точки кипения, а демократы в оставались в меньшинстве в обеих палатах Конгресса и не могли серьезно повлиять.

Ныне картина складывается такая. Расследование ФБР под кодовым названием "Crossfire Hurricane" началось в 2016, как контрразведовательное, и включало четырех персонажей (Манафорта, Флинна, Пападопулоса и Пейжа) . Позже оно начало приобретать криминальную составляющую. После увольнения Коми и странного поведения Трампа на встрече с Лавровым и.о. директора ФБР Эндрю Маккейб утвердил открытие контрразведовательного расследования в отношении лично Трампа. Розенштейн поддакивал Маккейбу и даже предлагал возможность прослушки: "“I never get searched when I go into the White House. I could easily wear a recording device. They wouldn’t know it was there." Проведенное тщательным образом, расследование контрразведки помогло бы вскрыть долгую историю российских контактов Трампа и ответить наконец на главный вопрос этого сообщества: находится ли президент США на кремлевском крюке?



В публичном заявлении о назначении Мюллера Розенштейн объявил, что передает ему расследование, о котором говорил Коми в Конгрессе: "The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017".

Коми тогда говорил про "Crossfire Hurrican" и подчеркивал его контрразведовательный характер.

Таким образом и у посторонних наблюдателей, и у руководства ФБР в лице Маккейба создавалось впечатление, что расследование контрразведки переходит под начало Мюллера. Чего мы тогда не знали и о чем ныне сообщает Шмидт: на личной встрече с Мюллером Розенштейн приказал тому не выходить за рамки криминального расследования.

Rosenstein curtailed the investigation without telling the bureau, all but ensuring it would go nowhere. <...> Mr. Rosenstein never told Mr. McCabe about his decision, leaving the F.B.I. with the impression that the special counsel would take on the investigation into the president as part of his broader duties. Mr. McCabe said in an interview that had he known Mr. Mueller would not continue the inquiry, he would have had the F.B.I. perform it.
“We opened this case in May 2017 because we had information that indicated a national security threat might exist, specifically a counterintelligence threat involving the president and Russia,” Mr. McCabe said. “I expected that issue and issues related to it would be fully examined by the special counsel team. If a decision was made not to investigate those issues, I am surprised and disappointed. I was not aware of that.” <...>
Installing Mr. Mueller as special counsel in May 2017, Mr. Rosenstein ordered him to examine “any links and/or coordination between the Russian government” and the Trump campaign. Many Democrats embraced the appointment as a sign that law enforcement would complete a full accounting of Mr. Trump’s ties to Russia.
But privately, Mr. Rosenstein instructed Mr. Mueller to conduct only a criminal investigation into whether anyone broke the law in connection with Russia’s 2016 election interference, former law enforcement officials said.

Юридическая зацепка в действиях Розенштейна была. Существующие правила о специальных прокурорах говорят только о криминальных расследованиях.

Но, как объясняют юристы, это не мешает делегировать специальному прокурору другие функции, в том числе относящиеся к ведению контрразведки:

Но контрразведовательное расследование лично Трампа, судя по всему, полностью ушло в песок. В частности не было сделано никаких попыток проследить его финансовые связи.

Можно предположить, что именно для того, чтобы оперативно прикрыть это расследование, Розенштейн поспешил совершить маневр с назначением Мюллера. Фигурами вроде Манафорта можно было пожертвовать ради того, чтобы спасти короля от шаха и мата.

5/ Were the CI aspects of the investigation ever seriously examined by the executive branch? This actually remains unclear. The report does not say whether the FBI ever engaged in a wide, comprehensive effort like the Senate’s to understand the CI aspects of Mueller’s work.

Позже зачистили все руководство ФБР, которое могло быть знакомо с изначальным расследованием и его обоснованием. Именно Розенштейн слил в прессу частную переписку Питера Строка, руководителя отдела контрразведки, чтобы подставить того под огонь республиканцев и в конце концов выжить из ФБР.

In a formal declaration submitted as part of the government’s defense to Strzok’s suit, Rosenstein owned up to being the one who made the call. He said he did so in part because the texts' public release by members of Congress was inevitable in connection with testimony he was set to give to the House Judiciary Committee the following day.

В конце концов поднятый в небо самолет Мюллера благополучно совершил мягкую посадку, а нам осталось "опять мучаться проклятой неизвестностью".
