Re: Tenancy at _________
Please be advised that I have received your Notice of Eviction Form on November 3, 2008 as delivered by your daughter on said date. Please note that should you wish to use this form again, you may wish to review the Residential Tenancy Act for the correct dates to use in the future. The date of delivery of the notice and the Date for the End of Tenancy are incorrect as the form was presented to me. A tenant has 10 days after the date of delivery to leave the premises, not less than 5. A tenant has 5 days to either pay the rent amount in full or give notice of an appeal with the Residential Tenancy Board.
That said, please find enclosed a bank draft in the full amount of $1100.00 as full payment of November, 2008 rent. This being received by you via registered mail ends your Notice of Eviction.
I hereby give my notice to end my tenancy at _____________as of 1200, December 1, 2008.
I give this notice due to several issues that I have attempted to resolve with you by reasonable discussion. These issues include:
I have requested every month that you give telephone notice of the time you will arrive for collection of the month’s rent.
When the above request was not honoured, Mr. Landlord and I discussed a resolution that he would arrive at 1700, on the first of the month. This was also not honoured.
Myself, my fellow tenants and even my next door neighbours have been bothered by your repeated visits (often up to 5 times in one day) to the home on and around the 1st of the month due to your lack of communication with me. You have insinuated to my friends and neighbours that I have been deliberately avoiding payment of the agreed to rent on time. This behaviour is harassing and invasive to my life. I have asked you repeatedly to stop. While the behaviour has reduced, it has most certainly not stopped.
Further, I have been forced to pay the rent in cash as my post-dated cheques have been presented for processing up to 5 days early, including my deposit cheque dated for September 12, 2007, and have either bounced or held up my financial dealings 3-4 times in the last year. My financial institution charges for each of these sorts of errors.
There has been one instance where Mrs. Landlord attended to collect the rent without a receipt. When I asked for the receipt, she replied that she didn’t have it and would bring it later. I asked her for my cash back until she had the receipt and she refused. I took the money out of her hands without touching her person and stated, “No receipt, no rent.” After spluttering for some time, Mrs. Landlord then called me a “stupid bitch.”
This sort of abusive behaviour is not acceptable at the best of times, and it certainly is not acceptable in front of my children (6 and 8 years old) who heard her very clearly and were frightened of Mrs. Landlord’s display of anger. My attempt at resolution was to discuss the instance with Mr. Landlord and we agreed that Mrs. Landlord was not to attend the property again. Thus far, she has honoured this agreement.
The leaking faucets, holes in walls, ceilings, doors and jams that were to be repaired before I began tenancy or shortly thereafter have not been addressed even when I have asked repeatedly for the repairs to be made. Also, the blinds for the main front windows on both floors were to be replaced with adequately sized blinds. These have not been completed.
The results of these requests and agreements not being honoured was that I was often not home, did not have the rent in hand or was extremely busy and could not come to the door…at one point recently, I was in the shower. This would seem that I am constantly late with the rent when a simple coordination of time would have relieved many inconveniences on all of our parts.
These issues are very stressful to me and do not allow open communication between myself, the Rentor, and yourself, the Landlord. The lack of repairs leaves my home looking ill-kept, the constant harassment creates conflict and this entire situation reduces my peaceful enjoyment of my tenancy.
This all said, I am finding better accommodations for myself and my small family.
Should you have any dispute with this notice, please present it in writing within 5 days. Should I not hear from you in this manner, I will accept the matter as closed and will be vacating by the allotted time on December 1, 2008. As I respect all people, please note that should I have the opportunity to leave the premises any earlier, I will happily advise you of such opportunity as soon as I am aware of it.
