Worth noting that in the second book, Draco implies that he would have been top of his class if it weren't for Granger. While he's undoubtedly trying to puff himself up, he probably gets pretty good grades.

I got this implication as well, which is always why the whole tutoring thing bothered me in fics for this pairing. He doesn't need it and would be lying if he asked Hermione to tutor him.

This said, I do like using the idea of him letting his grades slip after second year because he can't compete with Hermione grade wise and it depresses him to try and keep up with her. Never would I think of having him tutored to catch up if he so desired to catch up. He very well could do that on his own.
