WTF, if she's unable to consent either because she's special needs or she's 15 or both, force should be completely irrelevant.

That or this statute is written so sloppily that inability to give consent is assumed to consent so its not rape to have sex with people that are unconscious.

Statutory rape based on age doesn't apply in this case because the rapist was within a certain number of years of her (probably 16 or 17, I think it would have if he was 18). But other than that, yeah, if she's unable to consent, she's unable to consent. And even if she were, CONSENT IS NOT CONSENT IF IT'S NOT GIVEN FREELY.

How was no force involved? If he had a gun or knife, but didn't actually use it, wouldn't that be considered force through intimidation? Having a perceived physical advantage creates a situation of force by intimidation!
