Britain's OfCOM on free wifi:
"If you provide it as a public service (e.g., as a homeowner with an open AP for your neighbors to use), you're liable for any copyright infringement that takes place. But if you provide it as part of a business (e.g., free wifi for coffee-shop customers), and we don't care what you do - at least, for now."
