why stay? Because, as far as I'm aware, nothing HYBE has done thus far reaches a threshold that would warrant contract termination, and their termination fee would be astronomical if they can't show cause.
It's likely going to be a showdown either way. As much as everyone (rightfully) hates HYBE right now, NewJeans winning a termination suit and walking away with zero termination fees would be terrible for the labels and industry at large (albeit great for artists). Other labels regularly shelve artists and/or otherwise mistreat them (though the groups they shelve are not usually among their top performers). Having a group like NewJeans (which, all things considered and on the basis of what has been shared through the media, hasn't suffered mistreatment that is comparable to those groups who have successfully terminated their contracts for cause) being able to leave for cause would overturn that power dynamic and probably have a massive chilling effect on kpop as an industry going forward. And if they leave without showing cause and have to pay a termination fee, it'll be massive and they'll be stuck paying it back for a long time.
