I've been a professional a long time, and I've reviewed the images you've posted as "evidence". Only the Calvin Klein ad qualifies of all the images you put up. There are SIMILARITIES in the others, but the laws regarding copyright and plagiarism are specific. You can copyright an image, NOT a pose. For instance, in the image of the couple making love, it is a very SIMILAR pose, but there are enough differences that a court would easily rule in her favor. Same with the other ones.

This is accepted in the industry, and I expect that the Calvin Klein image was the one that really made people imagine there were more violations than there really were.

There was a MUCH MUCH worse case than this involving Nick Simmons (son of KISS singer Gene Simmons) who copied directly from Tite Kubo's BLEACH manga and then claimed it as his own. Simmons was even trying to publish his "manga", but it was yanked off the market the instant the publisher saw that he had simply traced the original works of Kubo.

What Kayono did on the Calvin Klein ad was wrong, but the rest of it falls within legal limits.

And that is why she won her case, not because she got one over on anyone. Trust me, I've been doing pro work since 1975, so I know my stuff.

It's disgusting either way. Just because something is not illegal does not mean it isnt unethical. And at least in the US, paraphrasing is considered plagiarism too (though I personally believe Kayono's offenses are more akin to 'word for word' plagiarism - how can you look at all the comparisons and NOT call that plagiarism?).
