Guwah, housing court Monday!

I'm both amped up and overly anxious. We had a second inspector come in today and the landlady, with her husband and oldest son, magically showed up. She has friends in the Inspection department(?). But yeah, the inspector wouldn't even let her in the house. She kept trying to 'explain' herself and he just dimissed her. She actually tried to argue that is was OUR job to fix things like electical wiring and plumbing back ups in the basement. Because yeah, we're SOOO good at that? It was pretty bad but funny at the same time. The inspector is a cat lover. When I told him my cat got sick and nearly died after drinking water in the basement, he turned red in anger. He's black and you should know it is very hard for us to turn RED in anger.

This last inspection was the nail in the coffin. I seriously felt BAD for my landlady. I'm not out to ruin anyone's life but she pushed me to this point. Not only that, this woman had to have been high on something when she put in the Eviction notice. Now, these are court documents. What she put down is all we can talk about. I've watched enough 'Judge Judy' and played enough 'Phoenix Wright - Ace Attorney' to know that if she brings up anything irrelevant to the case, it'll be ignored. I've read the summons word for word about ten times and the things she's claiming in there are damn near blatant lies. She said I didn't pay rent for the months of July, August, and September. I have check copies proving I did. I did withold rent for half of July until she made repairs. I told her about them in writing on July 1st and gave her the allowed 14 days to make repairs. She was a no show and no response so I didn't send in the second half of the rent. She claimed she was 'busy' with her RedCross job. (UH, what?) She's the only landlady I know that's too busy to BE a landlady...

So August rolled around and I paid the whole month in full so this bitch wouldn't go do something like, ya know, attempt to evict me. Still no repairs. We came to an agreement for the last half of July's rent. She does her job, I pay that portion of rent. She was even going to have my dad do some work at her new office to help pay it off. September rolled around and all was quiet. I paid the rent on the 1st like usual. Labor Day was on the 6th so no mail. Here's the really interesting part. She lives a city away but she kept saying she hadn't gotten the rent by Tuesday the 7th. I WORK for a bank. I know how every other bank in the country processes deposits. She banks at Wells Fargo. It takes WF EXACTLY 5 business days to clear a deposit from my bank to hers. She sent me a letter dated the 9th, priority mail from Blaine, MN to Minneapolis, MN, asking me to 'leave'. I got the letter Saturday, 09/11. No explainations, no reasons. Just, "This is not open for discussion. Leave by the 13th and I won't hold any back rent or damages against you and I'll give you a good reference for your new place. If this doesn't happen you'll be dealing with my lawyer and the sheriff."

So... explain to me why a PRIORITY letter from one city to the other took THREE days to get to me? She fucking lied on the date on the letter to make it seem like she gave us five days to vacate. I'd mailed her the rent already. As of that Thursday she claimed she didn't have it yet. My mom kept saying "Something's up. Stop the check." I stopped it on 09/12 which was Sunday the day I worked next. That check trid to clear my account on 09/13. I got a copy of the check being returned from MY bank. If she lies and claims she never got it/tried to cash it I have PROOF she signed it and put it in her account. Wells Fargo is really good at stamping deposits too.

I just.... I don't even know WHAT to think anymore. That's fuck up number one.

The second major fuck up is my lease is month to month since it expired on the 1st of July and I didn't sign a new lease. This is the LAW of rental properties. She had to give me a month and a day's prior notice to move. The letter dated the 9th, asked me to move out by the 13th. In what world is that 30 days? Apparently my unwillingness to leave is what 'forced' her to evict me. *CRACKS UP*

So yeah. Court on Monday. I've never felt more armed and ready in my life. The things I know about rental laws now is MIND boggling. I've memorized the codes and wording so I can preach this stuff back to the judge and throughly impress him. She claims I breached/broke/cracked/ whatever, my lease, but if I breached my lease and she still accepted rent KNOWING of the breach, she's forfeited her right to evict me. HRMPH! Take that! So with this, all of the above, and this last thing, this idiot is going to jail.

Still, I hope I'm ready to HANDLE this at 8 in the damn morning. *dies inside*.
