ok, maybe not... but i did pull through on getting myself out of this situation!
So, I went to court yesterday and within 15 minutes of me showing the judge (with the plantiff's lawyer on the phone) the proof that I A. am head of household B. don't make a whole lotta money (at least not enough to afford to pay off my debt without it hurting my livelihood) and c. receive social security survivor benefits for emily (all of which are reasons for exception).

she quickly granted me the exception and ruled that it was not right for them to do it in the first place.

a big fucking WHEW! not to mention, i'm pretty proud of myself for being headstrong and resourceful in this situation.

As I got home (after waiting for the certified court papers and taking them directly to the bank for them to unfreeze my funds and making phone calls to the direct contact i had for the person in charge of unfreezing my funds) the mail came and I had received a letter in the mail (it had been received at the clerks office the day before) from the plantiff's lawyer basically stating that they don't believe any of the above things i stated (in the alpha points in my first paragraph) above and that i needed to furnish proof to THEM.

(basically they were doing things to string me along as long as they can so I can get desperate and make a plea bargain with them or.. i really dont know what their intention was but if i hadn't called the judge directly I would've been sitting and waiting for a loooong looooong time)

So I called them and facetiously told them I would start sending them the $35 a month that the judgement had originally ordered that I pay them. They of course said they would send it back if I did and want the full amount owed to them. I laughed in their face. :)

Fuck em'. In a year they can no longer report me to the credit agencies because of the statue of limitations, so I will send them the $35 a month certified mail that way if they send it back i have proof that I tried to pay them "what i could afford" if they ever tried to fuck with me again. Its ridiculous because they want me to give them $3000, that is TWICE the original amount in interest alone. That should be illegal.

But anyways, I worked from home today and shaun stayed home because he was throwing up all day yesterday sick. It was a nice day. We went to Pei Wei Asian Diner for lunch and watched Otis, which was a great movie! fucking watch it!
