Italy's Oscar submission, Private, sent back to Italy

Further to my comment about the rules for Best Foreign Language Film Oscar, there is a report that the Academy rejected the film Private as Italy's submission to be considered for the Foreign Language Oscar because the film had no dialogue in Italian (although it was directed by an Italian and partly shot in Italy). I'm not clear how the Academy reconciles this with the ‘except’ clause in its rule: "The recording of the original dialogue track as well as the completed film must be predominantly in an official language of the country submitting the film except when the story mandates that an additional non-English language be predominant." (Emphasis added.)
