so, just because society changes, the constitution does not. it says what it says.
since the constitution strictly outlines the powers of the government, we can see that marrige and social issues are nowhere to be seen in the constitution. furthermore, the 10th amendment delegates all powers not expressively given to the government to the states.
therefore, marrige laws are strictly the realm of the states. a homosexual wanting to change this would have to take this all the way to the supreme court, and they would probably say what i said in the previous paragraph.
so, why not just amend the constitution? because that would go against all precedents in american history. we tried to legislate morality once (19th amendment:prohibition) and all that served to do was create some of the most powerful gangsters of all time. now, legislating homosexual marrige probably won't create the same situation, but it will cause many americans to feel extremely uncomfortable.
now, i agree that's not an excuse to allow it. but allow the constitution to come in and save the day. the constitution declares in the full faith and credit clause that the legal documents of one state are valid in all others. so, go to a state that allows homosexual marrige, get hitched and come home. the defense of marrige act does not allow this, but since it's blatantly unconstitional, we just need someone willing to challenge it.
