I hate to say it, but can we just like... make him give like a million dollars to a rape crisis group? That'd hurt him more than 40 days (down to probably 20 days) in jail...
I'm just... gra. The thing is if they do bring him back, they can ONLY bring him back on the terms of his plea bargain. Meaning something stupid like 40 days, in California that means what... a week? (Hello, Paris Hilton)

Well, judges are under no constraint to accept the terms of a plea bargain, meaning the current DA could push for a harder sentence. (Judges can accept the guilty plea and ignore the recommendations for sentencing, for example.) They'd still be limited to the max sentence at the time of the crime, which was considerably less in 1977, but could add up to a few years.
However, I believe there are additional charges that can be imposed for jumping bond. (A lawyer is free to correct me.) So that can add on, too.
I'm assuming the Los Angeles DA will have to follow the sentencing laws of 1977 due to that being the time Polanski accepted the plea bargain. The sentences are much tougher now - I keep in mind the story of that gal Jaycee Dugard who was found up north just recently after being kidnapped for 18yrs. The guy who took Jaycee was in jail on a kidnap/rape charge and only served 11yrs of a 50yr sentence (though federal court since it was across state lines I believe) - I don't think you'd see that happen again nowadays. The judge in the case back in 1977 can toss out the plea bargain and give him 50yrs. I also just saw this recent quote from the current LA DA:
"Some form of justice will finally be done," said Los Angeles County District Attorney Steve Cooley. "He received a very, very, very lenient sentence back then, which would never be achievable under today's laws, and we'll see what the court wants to do in terms of the sentence and the parameters within the case settlement they had back then."
I read Kate Harding's piece on the entire affair (excerpts from grand jury testimony; general trigger warning) this morning - hat tip to synthclarion for the link - and. Yeah. Just because he pled down to the least of the charges, DOES NOT MEAN that the other acts were not committed.
