Summary: Kevin and Scotty see Michelle after she moved back to the city with her new boyfriend. Based after the last episode so 5.08
A/N I not sure how this would actually play out in America, I’m not sure how this would happen in England either; even with some legal background. Let me live in my own world but if anyone knows how it would happen feel free to comment.
Kevin looked at the officer transfer his no he means their babies into the patrol car and it suddenly comes to him.
He runs to one of the officers and pulls him to the side “Can I speak to you quickly?” not waiting for a response he says “Would it be best if we had our contract with us?” and they both looked at Michelle hovering over the babies “If you had one, yes” the officer said concerned about the situation.
“I’ll go to our apartment then” Kevin said walking away then turned around and looked at the babies not wanting to lose them and he comes up with an idea.
“Can Scotty travel with you?” Kevin said, he looks at the babies “I can’t lose them again”.
The officer looks at Kevin and the babies and can see the fear on his face and wonders how a friend could do this to them. He nods as answer to Kevin’s question and sees him run off.

Scotty is sitting in the car just looking at his babies and not quite believing it; these were his kids and he thought back to the mistakes that occurred over the last year. He wonders if life would be the same if they had the babies. He knows that the pain of losing the babies made a hole in them; it nearly broke them, it wasn’t just the cheating that broke them up the starting point was the accident but it got a thousand times worse with the miscarriage.
He thinks back to how he manage to explain the cheating to anyone; even with Saul he said they were in a bad place because of Michelle’ miscarriage. He remembers the night of the cheating, not the act itself but the afterwards.
Flashback - Scotty
Scotty thinks about what he just did and tries to think about why he did it as well. He is back in the cafe and walks slowly through the building and walks out the back of the building.
He gets out his phone and plans to ring Kevin and tell him to come home so he can confess but he knows that tonight their marriage is going to be over. He didn’t want that. He scrolls down the list of names to Kevin and then see Kitty and thinks how the family is going react to the cheating. Kevin told him how they reacted to Joe and Rebecca infidelity. He was there for Julia and Tommy’s cheating, would he and Kevin survive it, he doubted it since the miscarriage.
He looks at his phone again and sees Kevin’ then scrolls down again and he sees the name he wishes to call not the one he should call.
It starts to ring and he starts to regret it; he is about to hang up when Jordan picks up the phone.
“Scotty, what are you doing calling me this late” Jordan asked tiredly, he might of just been woken up.
Scotty looks at his watch “I’m sorry I didn’t realize the time” he hesitates “I’ll just go” he is semi relived at Jordan not want to talk to him.
Scotty is about to hang up when Jordan says “Hey, wait a minute Scotty” Jordan said knowing it must of been important for Scotty to call him on his cafe’ opening night; plus he didn’t know what the time was.
Scotty chokes up; now that he had someone to talk to, he doesn’t know if he can say it. It will make everything more real.
“Scotty, what is wrong” Jordan said sitting up and worrying about what is wrong with Scotty.
“I did a stupid thing, Jordan” Scotty said still not admitting the truth to Jordan or himself.
“What did you do?” Jordan said worriedly; what could he of done, a million different things went through his mind.
“Kevin is never going to forgive me” Scotty said while he lent against the wall and slide down it.
Jordan knew what had happened but he couldn’t quite believe it and decided he must of misinterpreted what Scotty had said.
“Scotty, what exactly did you do?”Jordon said anxiously and slightly curious about the situation.
Scotty stayed quiet but Jordan could hear him starting to cry “Hey, Scotty, what happened?” Jordan said more softly. He was getting seriously worried and knew what was happening “did you what me to come over or you could come here” Jordan said maybe a face-to-face would help him.
“I can’t. Kevin” Scotty said thinking if he disappears Kevin would be worried and if Jordan came over then Kevin would know something was wrong.
“Then tell me, Scotty” Jordan said pushing Scotty.
“I” Scotty said stuttering.
“Scotty” Jordan said “you’re going to have to tell me” after Scotty was silent again.
“I cheated on Kevin tonight” Scotty said trembling with fear not cold.
“Oh god” Jordan said confirming his original thoughts.
Scotty was so silent that Jordan wondered if the phone connection disconnected.
“Scotty, are you still there?” Jordan wonders.
“Yeah” Scotty said convulsing “What am I going to do?”
“When you said cheat, do you mean” Jordan said as Scotty interrupted “Yes, we had sex”.
“This is going to ruin us isn’t it?” Scotty said hoping for a contradiction.
“You’ve been in a bad place lately” Jordan said waiting for Scotty to confirm with a “Yes” before he continued “Are you sure you don’t want to ruin it” Jordan asked honestly.
“Of course I don’t, I love Kevin” Scotty said getting anger “I know you’ve never liked...”
Before Scotty could finish it “Hey, I like him” Jordan said “he is your husband. I know we were mean to him when we first met but that was a long time ago. We saw how much he loved you and you loved him” Jordan said making sure he knows that he doesn’t mind Kevin “That’s why I can’t understand it, but like I said you’ve been having difficulty, so what happen to make this occur”
“I don’t know” Scotty said “He has been pulling away from me since the miscarriage”
“Why didn’t you talk about this” Jordan said
“He likes to deal with things himself; I know that. Then he didn’t show up for the opening tonight and I was hurt” Scotty said truthfully.
“So you went out to find someone else?” Jordan said putting himself in Kevin’ shoes for a second “How could you?”
“I don’t know” Scotty snapped back “I didn’t go looking for anyone, he was there and it happened. Please just tell me what to do”
“I don’t know what to say” Jordan said in shock “I really don’t”.
“I need to tell Kevin” Scotty said sadly “but we’re in such a bad place I don’t think we’ll make it. He is the love of my life, I knew it from the first day we met; how did I do this”
“Scotty” Jordan said hesitantly “maybe you shouldn’t”
“Secrets come out eventually” Scotty said knowing the Walker family.
“I’m not saying keep it from him forever. You’re in a bad place, maybe wait until you’re in a good place or something” Jordan thought it might not be fair decision on Kevin but maybe for now it would be okay.
“I don’t know” Scotty said “he is going to hate me either way. I don’t know”
“Scotty, the truth is if you want this to work, you either have to tell him now or later. A marriage can’t suffer on lies, you know” Jordan said.
“I know but I just don’t know how to” Scotty said “I can’t lose him”
End of Flashback
He was right, he couldn’t lose him. The miscarriage really pulled them apart not the accident; he just wishes they could go back in time and change everything.
********************
While in Michelle and Steve car
“Why didn’t you tell me” Steve said now that they were alone together. He might have supported her in front of everyone but he was angry with her. He had taken on the responsibilities of the babies’ father and it turns out they had not one but two already. He loved the twins like his own; what was he going to do without them.
“Because I wanted them” Michelle said honestly “I know it was wrong but I couldn’t help my feelings” she thought.
Flashback - Michelle
She looked down at her stomach and felt them move. It was then she realized that it was a mistake to agree to be a surrogate. She wanted the babies; she felt that she deserved them even.
It was at that point that she knew she had to leave; get perceptive on the situation, they weren’t hers, and they were Scotty’s and Kevin’s babies.
She thought back to her misspent childhood and how she got pregnant when she was younger; she had an abortion, her parents had wanted her too. It wasn’t until afterwards that she thought about want she wanted. She wanted the baby and she only had herself to blame.
When she agreed to be a surrogate for Kevin and Scotty she didn’t think about the emotional toll it would have on her. She only thought about making her friends happy and the financial situation it would give her to start her business.
She knew with her head that they weren’t her babies and she didn’t have a choice but her heart was another matter. Her heart said they were hers.
Once she told the guys about the miscarriage there was no going back; she might regret it but she needs the babies.
End of Flashback
“Michelle” Steve said slowly “Let’s fight for them”
“I want to” Michelle said slowly “but not sure if we can. I signed a contract”
“I don’t want to lose them” Steve said sadly
“Neither do I, why do you think I didn’t want to move back here” Michelle said angrily.
“Don’t blame me” Steve said “you didn’t have to lie”
“If I had, I’d have you looking at me like you are now” Michelle said worriedly.
“I love you” Steve said “but I’m not sure if I ever knew you” he continued honestly.
“Please” Michelle said “don’t say that. We can try fighting it but they are the parents! I’m not sure what we can do”
“Kevin said if we fought it; he would make sure we didn’t win and he would put you in jail as well” Steve said repeating what Kevin had said earlier. He waited for Michelle’ response and when it didn’t come he looked at her and she looked scared. “What’s wrong; he can’t do that, do you think?” Steve said getting scared to.
“He is a lawyer” Michelle said watching the shock on his face develop “he knows exactly want he is talking about”.
“What about saying they aren’t theirs” Steve asked thinking out loud.
“We’ve already admitted to it. Anyway, a DNA test would prove that” Michelle said
“Are you sure?” Steve said thinking of anything they could do to keep their kids.
“Of course” Michelle said without even thinking about it “Do you really think I’d do that” Michelle said anger and concerned about the way he was reacting.
“I just don’t want to lose them” Steve said thinking about how much he loved Michelle and the kids.
“What about the gay thing” Steve said coming up with more ideas, hoping one would work.
“No” Michelle said adamantly “We are not using that as a reason; I won’t do that to Kevin and Scotty”
“But you took their babies” Steve said cockily.
“It wouldn’t work anyway” Michelle said coldly.
“We need to figure out something” Steve said determinedly.
“Yeah” Michelle said worriedly “I’m just not sure what we can do or say” she continues defeated.
“ We've raised them” Steve said “that has got to count for something”

Police Station
On the way to the police station the officers called ahead and said they would need someone from child service to be there plus maybe a counsellor.
Once they arrived the babies were put in with the member from the child service; while the police officers complied the witnesses’ statement and birth certificate and once Kevin arrived a copy of the contract was all given to the social worker.
The social worker came out after an hour or so of reading the evidence and came out.
Until that point Kevin and Scotty were kept apart from Michelle and Steve.
Both couples looked nerves and were scared of what would happen; they were holding each other praying for an outcome that would favour them.
The social worker goes up to both the couples that were now put together in the same room but as far as way from each other as possible.
“Hi, my name is Shelly Dawson. This is a difficult situation and I’m sorry to be meeting you all under this situation” she said as she introduces herself.
“I would normally want a DNA to confirm paternity but from the evidence and especially from the witness statement, I don’t think that is up for debate, is it” Shelly said more as a statement than a question.
Everyone agrees with the statement not sure where the conversation was going to.
“So my decision is.........” Shelly said.
