If you have already decided you would like to, why do you not simply ask HIM? I would not think that you would allow yourself to be restrained by outmoded custom.
You have already gotten him past his reluctance to get involved with anyone. This is simply a matter of scale. As I understand it, you have not had good experiences with relationships, either.
It may be that he will not ask at all, under the assumption that his feelings are implicit, and do not require a bonding in the eyes of American law, as that law has failed him so drastically.
Or, conversely, perhaps he will not ask because he does not wish to burden you eternally with what he may or may not inwardly view as his excessive emotional scarring, loath as he might be to ever admit to such a thing. He may wish to continue to allow you the freedom of choice to leave without consequence... in which case, you will have to make it known to him that you do not view this as an obstacle.

Frank hasn't had the best experiences with relationships, as I'm sure you're well aware. I'm not entirely sure how to work around that impediment.
