I had a reply here, but I changed my mind when I read up on this on flickr. By default, anything you post on flickr is copyright with all rights reserved. This can be modified by you as well.

So, in response to your list of items, I would say 1, 2, 4 and 5. It's a blatant copyright infringement. I would also report it to flickr immediately.

I recently had a commercial site ask me to use one of my photos recently. No compensation was offered, but they would credit me and it would link to my high resolution version. I was flattered and approved of the request.

Flickr has some good articles on this if you go to Help and search for copyright. I learned something new today.

Not good. Totally confront him on it. I've found half the time people think Flickr is just Google image and save/alter anything. At least they asked.
