Detroit Skyline - II Originally uploaded by
jdurchen. So, on Feb 2, 2007 (Yes, 10 months ago) I got a request on my flickr account that said
"I love your picture of the detroit skyline at night - may I use this picture on my website? I will give credit to you, of course - how would you like me to word it?"
Now, this is pretty flattering. It is also pretty presumptuous. I mean, he assumes I will say yes by asking how I would like credit worded. So, I figured it would be somebody that lives in Detroit and liked my photo and would put it on their header or something so I figured, what the heck, I'll bite.
So, I reply to him
Where is your website? I generally don't mind but would like to see where you want to put it.
Thanks,
James
To me, this was a friendly way of saying "Tell me where you are going to put it and we'll see."
Well today, 10 months later I get this.
Sorry about the really late reply, I don't come here often. The photo is at www.henryfordem.com/detroit.htm - please let me know if you'd like me to change the way it is credited.
He has used my image on a commercial site. Would you consider this to be "his site?" I certainly do not.
I feel like this is blatant theft. And the fact that he went ahead and did it without checking back is inexcusable. So my question is...
Should I
1) reply to this guy and demand it be taken down
2) Demand compensation for said work
3) Let it go
4) Send him a sternly worded email?
5) Contact henryford and inform them of infringement?
6) None of the above
7) All of the above
8) Something totally different?
Yes, I was credited, but he altered my picture. He did not correctly site which picture. He did not get my permission for a commercial site in any sense and the picture is clearly copyrighted on the site.
Thoughts?
