The more I read these cases in Statutory Interpretation, the more cynical I'm becoming. It truly seems as if in these cases, the Supreme Court sits down, reviews what cases are being petitioned to them, decided which ones to take and then decide how they want the result of each case before they even hear any of the arguments. I mean, they follow one canon of interpretation in one case and then turn around in another case with a similar situation and do the exact opposite. It's like wiping before you poop, it just don't make no sense. I hope that this is not the case, but, damn in some of these cases it sure seems like it.
Prof. Moritz tries to make sense of it all. He suggests reasons and rationale for the madness. But, I think he really has no clue why they do it either.
