Some tags are from our original list (like "United States") that needed to be removed. I'd do the same for "news" but there's over 100 posts tagged with it. It was one of the first, so it has some posts from a long time ago.
The hierarchy/sub-category idea is a good one, but yeah, LJ isn't that far ahead. I can rename tags, which is nice, but I can't merge similar tags, so I have to go through each individual post and change the tag. Guess how I spent my afternoon, and will spend tonight? It needs to be done, but it's a pain-in-the-ass.
LJ does, or did, have that. I think they've increased the number of posts for each tag, but we do have some filling up (like "gay marriage"). I don't know if old posts will lose their tags or if new ones won't take them. If we reach that point, I'll probably create a "same-sex marriage" tag or something like that. Although "marriage" is being folded into "gay marriage" tonight. Same with "equal rights" and "equality" (I'm just not sure which one I'll keep). I've done a lot of it already, with smaller tags.

I would suggest that if it gets to it and new posts need a new tag to just add "2" so you have lawsuit2. It may look kind of awkward but it would be clear to people that it was the same tag, just more recent posts.

I just spent quite awhile on removing the "marriage" tag and merging it with "gay marriage." I actually agree with you that "marriage" is better because it's broader (and I came across a handful of posts tagged as "marriage" that weren't gay). However, there were 227 posts under the "gay marriage" tag, and only 70 or so under "marriage." I went with keeping the one that is most used, which saved me a lot of time.
