I don't know you and I only read pornish_pixies very sporadically during 2004 but I was pointed to this post by ook and I just wanted to say YES to everything you say and how nice it is to hear someone rational, especially someone who's been directly affected. I, too, can't find it in me to get annoyed with LJ. With the people who fingered those comms, yes, but I have loved LJ too long and they have provided a wonderful service to me for over five years so I'm not going to drop them over one issue -- and I still haven't read a detailed explanation of LJ's side of this, so I'm not going to jump to conclusions. I thought that the TOS they have protected them but also us because if they don't know about us, then we can do what we like. But when it hits the radar then, as you say, this kind of shit happens.
This also isn't a First Amendment issue. Six Apart and LJ can do this. They're not the government...First Amendment rights only apply to U.S. government restriction of free speech. Thanks for this line! Great formulation. Because I may fume but I did agree to the TOS and they do say that LJ can suspend my LJ without warning. And no, they are not the government and have no duty of care towards us at all, actually. Yet they do care. They don't like suspending journals. I'm sure the Abuse Team have better things to do. But...!
