Okay, because I just did a quick skim of the flist via the Sidekick... :)
I want to clear a couple of things up. First off, Deletegate wasn't in any way targeting fandom. Yeah, fandom got smacked pretty hard in some cases, but it was across the board. And yes, some comms that did need to get deleted got deleted. It's just some of the wheat got mixed in with the chaff, you know? That happens. It's not right, it's not fair, but it happens.
Second, everyone. Calm down. Calm is good. Trust me. *g* I'm trying to Zen out as much as possible today meself. Zen, Zen, Zen. Pretty Zen.
Please don't go around slamming LJ or LJ Abuse on my behalf. This is a legal/corporate issue and I really, really, really won't have people using what happened to
pornish_pixies to bash Abuse. They did what they were required to do by Six Apart and I get that. I hold absolutely no ill will towards them. Does that mean I'm not angry? No. I'm frustrated with the individual(s) who chose to report this and I'm frustrated with the kneejerk legal mindset that let to this suspension. But, having said that, I do understand even that mindset, particularly in the legal/political climate regarding the Internet today. This also isn't a First Amendment issue. Six Apart and LJ can do this. They're not the government...First Amendment rights only apply to U.S. government restriction of free speech. Six Apart is trying to legally cover their ass, to prevent themselves from being held legally liable and you know what? I don't blame them.
Yes, this needs to be fixed. Yes, it needs to be addressed. But believe me when I say there are things definitely afoot about how we can deal with this situation. I've been in communication with a number of people in the past twenty-four hours; there are discussions going on about what can be done on several fronts both inside and outside of fandom to settle this in a calm, rational manner that will work for all sides. Give us a chance to figure some things out, to be in touch with some people who might be able to help, and as soon as we do, we'll let everyone know. In that regard, if the owners of fandom journals who've been suspended can please email me at femmequixotic@livejournal.com, I'd appreciate it. Er. If you're an owner of one of the comms that should have been suspended...don't. Because yeah. I'm so not even going there. Fandom journals/comms only, please.
Also, for people who might surf over from non-HP links...I just want to clarify for anyone who stops by here who isn't familiar with pornish...it wasn't an incestfic comm. It was a community that focused on R and NC-17-rated Harry Potter fanfic less than 5,000 words long that had thousands of people watching it during its four-year history. There was a no-censorship policy in place from day one, four years ago, that remained in place throughout three mod changes, so it did allow incest fics, yes, to be posted but they were in no way the majority of the fics posted to the community...in fact they were a small, small, small drop in the bucket ficwise. To the best of my knowledge
pornish_pixies was not TOSed for the content of the community but rather only for listing incest in the userinfo.
In regards to what I'm going to do about pornish fics that might fall into this TOS gray area...my first gut reaction was to ban them if a new gathering place started up, wherever that might be, in an effort to protect the other fics. However, after having some sleep and talking to some people, I'm now considering options and trying to find out what legal protection we might have. And how to protect wherever we might end up gathering from being legally responsible too. Because, hey...call me crazy, but I kind of like LJ and don't want them to get shafted either. Or greatestjournal. Or wherever. :) I don't like censorship at all. I've never censored anything in any community or fest I've run and I'm not thrilled about the idea of doing so now. So if I can prevent that, I'm going to try. I can't make any guarantees right now. But I'm going to try.
I want to say thank you to all the people, in HP and in other fandoms and who aren't in fandom at all but who have concerns about Internet rights, who have come over this way to show their support. It's amazing and I'm touched (and to whomever sent the vgifts anonymously--thank you too.) I'm still trying to save posts (unfortunately, it's something it looks like only I can do), but I'm hoping to know soon what sort of help I might need in pulling the code from what LJ's giving me. I also greatly, greatly appreciate all the people who've offered to resubmit fics and who've offered to help repost. I'm totally overwhelmed by your generosity. Thank you.
