For the record, it's a crime in the State of California (
23111 V.C.) to hold a burning ember out your window at ANY time... you can be fined up to $1,000.
If you actually drop your cigarette (lit or unlit), there can be ANOTHER fine of up to $1000 for littering (23112 V.C.).
If you do this during a
Red-Flag warning (low humidity and/or high wind days which have a high risk of fire danger), you can also be charged with the FELONY crime of arson (although unlikely unless you actually start a fire).
The Paul Buzzo Act (23111 V.C. in the California Vehicle Code) which prohibits cigarettes from hanging out your window has been on the books since 1970 - several years before littering the public highways was made a crime. The statute states it's illegal to throw a lit or unlit cigarette or cigar or other object with a burning ember out your window. Case law has since established that just holding a lit cigarette out your window shows intent to drop the ashes on the ground, and therefore also violates this statute.
