I am trying not to panic. Or cry.
S (the barrister who likes me to do bundles for her) wants me to do a particulars of claim in a case about damages payable for unlawful detention -- the main issue, the fact of the unlawful detention, has been admitted by the Home Office. Drafting was my worst mark on the BVC and that was for fairly simple particulars. I do not know how damages are assessed for unlawful detention, and I do not know how to set out duty, breach and causation. Nor does S -- she hasn't done a particulars of claim in 16 years, she says, which is why she's put me on it. She and seemingly every other immigration barrister at chambers is at court. I have no precedents and no idea what text to look in for principles or guidance in this area. I am blindly searching online for caselaw. G (pupil supervisor) has a five-day contested hearing starting tomorrow so unless S says I can get this to her by Monday, I basically have today to do it. None of this is helping my mood.
