the supreme court ruled on the matter, but it's not like they can say he coomitted war crimes before the court ruled. that would be like you or i say play cards and then the powers that be passing a law saying playing cards is now illegal... and its WAR folks.. a war unlike other wars simply cause we aren't fighting a counrty, but individuals operating out of Many countries.

So if it's a war then it follows the laws set down by the Geneva convention. Which means he has already broken laws that this country agreed to in good faith. Laws that we expect others to adhere to because we don't want our men and women treated like we've treated the men and women we've captured in this war. What he is attempting to do is make the courts decision when handed down moot. Your analogy is incorrect. It would be more like if we were playing cards and you cheated, then went and changed the rules in the rule book before anyone with any authority had a chance to say "yeah you cheated ( ... )
