A Kentucky mom was awareded 1.4 million dollars in what has to be the worst delivery malpractice suit ever. I'm not one who is usually in favor of people suing for things all the time, but for this, 1.4 million seems incredibly LOW ( Read more... )

My husband told me about this earlier today and I haven't been able to get it out of my mind. I know the baby wouldn't have survived anyway, but to be decapitated is just so awful.

yeah, that doesn't matter :/ its bad enough that she had to deliver a baby that was not going to live, then on top of that, having these morons decapitating the baby?

its likely the baby wouldn't live, no, but the mother could have at least had a few moments with her child that still had a head that was not sewn on and maybe that would have helped her just a little bit in her grieving process

Sounds like it's implied that the suturing was done since the mother has the right to view and interact with the remains.

It said she wanted to hold the baby, and I imagine she wanted to hold an intact baby, not a decapitated one. :x

Based on the details of the article here, it was a freak accident that was the result of numerous factors all colliding to compound on the fact that the pregnancy wasn't viable to begin with.

Yes, the woman had a terrible, tragic experience, but was that the fault of the doctors?

Doesn't sound like it. Sounds like the woman was awarded a sum out of pity, not necessarily to punish the doctors, seeing as punitive damages were declined.

If a child was struck by lightning and died in the ER, it wouldn't be the ER docs fault.

That sounds to me like there was negligence.

Yes, and shortly thereafter, it responds with the doctor saying he did remove the cerclage.

Pretty much every point listed is refuted by either side, with no other information given other than "lawyer contends..."

I don't believe that. 21w fetuses/babies are not so delicate that their heads will rip off while coming out of an open cervix. One that is only partially open with some kind of obstruction, though? The body is thin enough to get through and the head would have come out if the cervix was open.

I don't know what to say, really. All of the fact of the matter court room drama aside, I feel bad for the lady regardless of circumstance. That must be a rough thing to go through.

I can't really say much beyond that. I am a bad judge of court room drama and justice.
