This is a huge danger my mom and I are starting to notice about my mom's brother and my (rather evil) Aunt and how they're basically abusing my grandmother's estate (she's still alive, but suffering from dementia) by using it to pay off the loans of my uncle's business, which my mom is heavily invested in.
It basically at the point where my mom is also starting to bring in the lawyers to look things over and hopefully scare my uncle into not spending away my mom's inheritance.
I'm a little confused. Did the property pass to her on your father's death? Is it his will that says he has no children? That certainly would belie any "sound mind" basis.
The aunt is the one in the nursing home.
In any event, it certainly sounds like you have a good case. Good luck!
The will makes no mention of my father. It says that other than my aunt, my grandmother has no other children, or their issue (that's me) that are living.
My father was a leach on my grandmother, I could certainly see her writing him out of the will, but he could still contest it if he were alive. Regardless, the sins of the father are not the sins of the son. I want what is due me.
