Time to get nasty!
My aunt is trying to fuck me out of a sizable inheritance: Here's the letter that I sent off to a lawyer today:
Bob, thanks for your time today on the phone and your review of these docs.
The will chiefly deals with person effects. This is of secondary concern as I'm mostly interested in the real property that would be covered in the trust, but both documents should be scrutinized. I believe that my aunt fraudulently abused her power of attorney to write me out of any inheritance. Both my grandfather and father's deaths proceeded my grandmother's death.
As I understand inheritance laws, I am entitled to any of my father's inheritance, or half the estate.
Some discrepancies that I noted:
Page 1 of the Will: "I have no other living children or deceased children who left surviving issue."
That implies that neither I, nor my father ever existed.
Page 5 of the Will: "In witness of this and declaring...sound of disposing mind and memory..."
Page 6 of the Will: "...appeared to be of sound mind, legal age.."
When this document was dated and signed, she had already been admitted into a care facility because she could not take care of herself due to advanced age related dementia. My husband and I visited her in the facility a month and a half after the document was written. She did not know who I was.
Page 4 of the Trust is the only mention of my existence in which I've been left $1000. Insulting, but not the point. I believe I am entitled to half of the estate and am willing to fight for it if necessary.
I did not attach the 3 "Quit Claim Deeds" for the property listed in Appendix A of the trust. If you require these docs, let me know and i'll scan and send them.
The trust is mostly boilerplate, but you might be able to find some discrepancies that I glossed over. If you require any payment before doing a deep dive into these documents or pulling any other legal documents that might be on file let me know.
