Is anyone familiar with what the noise laws are for apartment buildings? Because I can't handle listening to this Shakira song, at this retarded volume.. on repeat, over 10 times consecutively, starting as early as 8:30am ANY MORE! This is torture, pure, torture. I've tried to be a good girl and just let it slide, but this is becoming an everyday ( Read more... )

Oh honey! I can sympathise with you to no end on this one as I have been in many many a situation just like this (and managed to get neighbours evicted because of noise violations on three seperate occaisions). The first thing you need to do is go online and hunt around for the noise by-laws in Mississauga (these differ depending on which city you live in). Once you have obtained this copy, be sure that your neighbour upstairs is in violation of them, and then you know you have legal recourse. Actually, before that, talk to your building manager and see if your building has particular rules that forbid this kind of behaviour (my building is currently zero tolerance so any noise audible from a neighbour is unacceptable and can cause them to be kicked out).

I have a feeling though, that unless your building has a rule, you upstairs neighbour is not doing anything to violate noise bylaws (unless the decible level is high enough). Noise bylaws generally state that it is unacceptable to play loud music and the like before 7am and after 11pm, so since she is within those times there may be nothing you can do. I would still tell my building manager about it however!
