not because I necessarily disagree with you, but how does this prove anything other than he doesn't know exactly the wording of the law and doesn't want to get caught/get embarrassed by having a word off, and having people reading way too much into that?

What is YOUR definition of torture and what is your proof that the U.S. is doing that? Are we breaking our laws, or are the laws written too loosely?
