That's my problem with this statement. It seems performative because he's not actually saying anything. It's too vague.

I can’t imagine him, as both a lawyer and a journalist, saying anything more about a case that he hasn’t thoroughly researched, than pointing out that there’s something not making it to the headlines. I don’t think it’s preformative.
