It has always been in the public domain, because Roger Corman made the film on a bet, that he could make a feature in three days. He did it, but was unable to secure his rights to the film, therefore his best known film has never made him any substantial money.

The cheap duplication houses have made millions from its notoriety over the years. Go through any old video store and see the different versions that are available. From film to tape to disc and now the internet, Corman hasn't seen a dime from alternate distribution outside his own, and can't do a thing about it.

This is also how Howard Ashman and Alan Menken were able to make it a musical on a shoestring budget when they were first starting their respective careers in songwriting.
