LODI - Three members of Lillian Best's family wept as bailiffs brought Timon Joel Pool into court Wednesday to be charged with murdering the 20-year-old Vacaville woman and her unborn child.
Prosecutors will decide later if they will seek the death penalty against Pool, a 28-year-old pizza delivery driver, who is accused of strangling Best early Sunday morning. The two had lived together in the 11600 block of East Peltier Road in an apartment behind Pool's mother's house.
Pool did not enter a plea during his arraignment in the Lodi branch of San Joaquin County Superior Court. Judge Ronald Northup scheduled Pool for further arraignment at 1:30 p.m. Wednesday in Stockton, where future hearings will be held. Pool is being held at the San Joaquin County Jail without bail.
Best was 13 weeks pregnant with her second child, Assistant District Attorney Chuck Schultz said Wednesday. Under California law, murdering a woman who is more than eight weeks pregnant is a "special circumstance" that can be considered during a trial and sentencing, and ultimately can result in a convicted killer's execution.
