asked my head of dept if he had any objection to me doing consultancy work using that code. He said it was fine

I'd get that in writing if I were you!

I did think of this. I have had a reply from the consultant about it and that they would bear me in mind if they did have anyone who needed the same work done. So some work might come my way.

If I ask for it in writing it would probably have to go above my HoD, so it may get nixed at that level. If they do ask me to do some work I will check with the boss and make sure then.

We are fairly laid back here so I doubt they will make a fuss.

AFAIK the college contract specifically states that they own ANY intellectual copyright you may develop whilst working there (whether on your time or not). With that said they are unlikely to be very interested unless you start making millions out of it - cover your bum and get permission in writing from someone senior enough to give permission!
