erm... thingy?

Anyone know how to go about getting an erm... thingy... that legally spells out who gets custody of one's child in the event of your death? And what is it called?

FYI, in the event of both our deaths, we want Edward to be placed in the custody of my brother Stephen and his wife Emily.

Truthfully you should have a family attorney draw it up for you. At the very least you should consult with one to be sure that all of the points are covered. A typical fee for Family Attorney is about $100.00 an hour maybe more/ maybe less- depending on the Attorney and their affiliations.

Your will.

BUT, Landon and I don't have Wills yet (shame on us!) but we have declared my brother Stephen and his wife Diana to be the godparents of Rhynn.

I think you can do a Will at legalzoom.com if you don't have anything complicated...

It's called a Power of Attorney. You can get them online but you'll need them notarized.

I was told it was a will. I need to change mine since Jeremy's adoption. He's not on it.

I'm no lawyer, but I believe it's specifically called "Durable Power of Attorney" and is usually included as part of your Will. Any family attorney should be able to write one up for you for a minimal fee (less than $1000).

...wandering by in friends' list of costuming...a 'durable power of attorney' is a separate document from the will and assigns responsibility over your money and business matters *while you are still alive but incapacitated*: it doesn't say anything at all about who gets what after your death...the will is the place to do that...
