This Morning in the Supreme Court

May 19, 2008 08:53

It's the Dormant Commerce Clause, Charlie Brown! Oh man, it's been awhile, DCC, but I'm happy to see you rear your stern, fanged head once again. However, when you play scissors in Roshambo, apparently waste management protectionism is paper, but tax and bond schemes are rock. Epic fail!

In other decisions to issue from SCOTUS today, the Ninth Circuit got reversed not once (hey, a Washington case!), but twice. And it's only Monday. It's almost a joke at this point, how often the Ninth gets reversed: if you win in the Ninth Circuit but SCOTUS accepts cert on your case, you are doomed.

In other other decisions, offering people child porn is illegal, mmkay. I'd actually like to read this one more closely since apparently Congress tightened its game up after its previous attempt at banning the pandering of child porn got struck down as unconstitutionally overbroad. Eugene Volokh, who wrote my First Amendment textbook, thinks this case is pretty significant, actually.

Also, I came to my 8:30 class for the first time since Wednesday before last, and the first time on a Monday since the first day of the quarter. It's ostensibly the last day of class, and the syllabus said we were gonna have a review session, so I thought I might as well show up. And apparently CLASS WAS CANCELLED. No e-mail went out to this effect! I got 5 hours of sleep! Dammit!
