Only problem I did have was it being used without permission, it's a grey area yeah, and hard on either side to maintain - either your work being used or you unknowingly end up in a crowd shot somewhere without your express permission. However, if I see my photos being used for something without my permission I contact them about it, if someone in a crowd shot I took found it and wasn't happy, i'd take it down. In Au you don't need to gain express permission within a crowd context. As the photo was of the crowd and not specifically of your friend even though he's in it, i'd say it'd turn into a pointless headache if your use of the term litigation was a pointed one, as it's impossible to gain permission of a crowd and is currently legally acceptable to take/use them.
But as I said, if someone even within a crowd shot wants it taken down, I do. Bit annoying, yes, i've certainly ended up in crowd shots i'd rather not have. No doubt they'll change it at some stage but for now, photos remain intellectual property of the photographer and crowd shots are fair game. Keep in mind I didn't write the rules or particularly hold with them, am simply responding to your question.
