GEICO wants me to try negotiating with Jackass' insurance representation on my own. Because the only way they'll do it for me is if I get the repairs and pay my $1,000 deductible first. (The repairs for the exterior come out to over $1300; this appraiser didn't put it on the lift either so all we have are cosmetic damages accounted for.) They claim it's legally necessary for them to represent me. It's possible that they wouldn't be able to reimburse me my full $1,000 from the other company, so I could be on the hook for all of it if I went that route. Or I could go to small claims court, and who knows how long that will take!
I have to go through this hell even though the police accident report agrees with my account, the other driver was given a citation for failure to yield, and my car's damage tells the actual story. Of course Jackass' account of the event is different: Driving clients is his job, he had a client in the back, and it would look bad for his job if he admitted to recklessness. If an insurance company can just refuse to pay and get away with it because the victim isn't financially able to get things done, why not?
