When Dan and I bought our townhouse last year, we got a signed and sealed copy of our property survey. On the survey from our city courthouse, we have a drainage easement that comes 25 feet into our backyard, and a utility easement that reaches 10 feet into our front yard.
Here's the issue. A local phone company is doing utility work in our area. They left notes for everyone stating they'd need access to our backyards, and if necessary, would take down parts of fences to do their work, which would take 2 days, tops. Why they would need to do work in the back, when the utility easement is in the front, I have no idea, but we didn't think much of it.
As I said, we live in a townhouse, and there is no back access to our house...to get in back, you must either go through our house, or take apart our privacy fence.
Instead, a large section of our fence was broken (literally..the pieces of wood are stacked in a corner of our yard), and for the past *two weeks*, the workers have trampled down our newly grown lawn (huge mess when we moved in..we reseeded the whole thing), and have dug, filled in, re-dug, left open for 6 days, filled in, and re-dug a huge hole smack in the middle of the yard. WE were just gonna wait it out and see what happened- we came home to find a huge green..I don't even know what it is, power box? ...in the middle of our yard.
Called the phone company again, they swear up and down our house has a utility easment in the back. They call the on-site sup, and he drops by our house and looks over the survey with my husband.
It boils down to this- the phone company told the utility workers that
our utility easements for this neighborhood were 25-feet up from the creek, into our backyards. So they made a huge mistake- destroyed our yard, broke our fence, and have made our backyard unuseable for over 2-weeks.
The site supervisor said that once they confirm that our land survey is correct, they would remove the power..thingie...but here's my big question. If a mistake was made when we purchased the house, and the land that we purchased is different than what we thought, what, if anything, could be done about it?
The bitchiest part about it all? We don't even USE the phone company who's doing all this work. We got fucked by them before on our bill, and dropped them before we even moved into this house. :P
