 This office has been retained to represent the interests of prisoner Yuri BEKETOV (DOB: 1970) in connection with negligence by Ukrainian officials, namely, Chief of Kyiv SIZO #13 Mr. Starenkiy S.E. (situated at Lukianivska street, #13 in city of Kyiv), who refused to urgently transfer prisoner BEKETOV to the hospital, and thus  denied Mr Beketov access to  appropriate medical aid, which resulted in such a terrible diagnosis: purulent persisting fistula (suture sinus), high temperature, high risk of blood poisoning.

Prisoner Yuri BEKETOV is in need of  curative surgery re purulent persisting fistula! This precise diagnosis was set by doctors of ambulance “103”, who arrived on emergency call in the morning of 22nd October 2009 to the building of Kyiv City Court of Appeal. Doctors of ambulance also stated that the lack of urgent and adequate treatment of patient  - namely: specialised curative surgery in permanent establishment (hospital) - may take a tragic turn for the prisoner Yuri BEKETOV.

Yuri BEKETOV has a suture sinus (abdominal (wall) hernia) since January 2007. In February 2007 he had to come through surgical operation regarding his abdominal (wall) hernia. In February 2008 he was arrested by Ukrainian police, and was heavily beaten in Shevchenkovskiy district police station by vice-chief of Shevchenkovskiy ROVD. It ended up with significant worsening of BEKETOV’s health.

Prisoner Yuri BEKETOV, who has been kept in detention  since February 2008, is held in Kyivske SIZO #13 and is awaiting trail in his case.  For more that 1 year already  administration of Kyiv SIZO (firstly: Mr. Alexander Balduk, ex- Head of Kyiv SIZO, and currently - Mr.Serhiy Starenkiy) had been refusing and continue to refuse to direct Yuri BEKETOV to specialised hospital or other permanent medical establishment.

Thus BEKETOV cannot for more than 1 (one) year (!) already receive adequate treatment - that is curative surgery re purulent persisting fistula.

Lack of adequate medical treatment resulted in significant worsening of BEKETOV’s health in last days! Yuri BEKETOV told me in Kyiv court of appeal on 22nd October 2009 that he has a permanent stomach ache, that he cannot normally neither  walk, nor sit or stand! I was able to witness his sufferings with my own eyes. As well as other people, who were present in the court 22.10.2009:  attorney-at-law Volodymyr Grechanovskiy, Ilia Mogyla, Olga Beketova (wife of brother of Yuri) and others: more that 10 people or so in total. Contact information of those persons is available upon request.
Besides, us, attorneys-at-law Volodymyr Grechanovskiy, Ilia Mogyla and myself, after conversation with doctors of ambulance, who made medical examination of Yuri BEKETOV in the morning of 22.10.2009 (just in the courtroom), and taking into consideration rapid and significant worsening of BEKETOV’s health, high risk of blood poisoning of the latter  -  requested  the presiding judge of Kyiv Court of Appeal Mr.Glynianyi Viktor to order the immediate transfer of Yuri BEKETOV to the hospital, where he can get urgent adequate treatment.
Judge Viktor Glynianyi refused to refer Yuri BEKETOV to the hospital without reasoning. And suggested to us to make  a request to this effect to guards, even though it is  not in their competence to act on such requests.
There are no other effective remedies in Ukraine to exhaust in respect of this situation.
Please consider this letter as complaint to European Court of Human Rights, based on art. 3 of European Convention of 1950 (inhuman and degrading treatment to prisoners).
On the ground of  Rule 39 of the Rules of the Court, I hereby place a request for interim measure, namely the transfer of Mr Beketov to a hospital, where he can receive the long overdue and urgently needed aid : specialised curative surgery of purulent persisting fistula (suture sinus).
