in 1922, joe kirby successfully annulled his arizona marriage to mayellen kirby, citing antimiscegenation laws. mayellen's appeal centered on the argument that such laws were unconstitutional: as a person of mixed race, she could not legally marry anyone and thus was not afforded equal opportunity under the law. she lost (what colored woman could afford a decent lawyer?), but she had a point, and i'd like to think that argument could win today.
so what would it take to get an intersex person to sue their state for marriage rights?
