I won't - almost can't - mourn the death of Antonin Scalia. The man was clearly intelligent and well-spoken, but as The Onion put it, he lost a 30-year battle with progress. This year's Presidential election has become even more important ( Read more... )

I will note that if they do hold off that long, it'd be easily the longest-delayed confirmation ever.

They're trying to cite 'in previous times there's been an opening the year before...', but the old rule-of-thumb was 6 months, not 11. There's a ton of time.

Oh, and the President *can* do recess appointments. Eisenhower did 3. Confirmation is not required.
