Here are some things I've thought about:
What type of class is your son in? If I remember correctly this is your son with ADD? Does the sub have the qualifications to be in your child's class? Was the sub the only adult in the room when the incident occured?
I think you should get a notebook and keep a log of everything that happens with your son regarding this incident and anything else that happens to him. Write down dates and times that incidents occur.
Did the sub admit what he did? What were the other student's versions of the incident?
I had an incident last year where a parent accused me of shoving her child in the cafeteria. THIS did not happen. And I had another teacher with me who could verify that it didn't happen. And the reason why I'm telling you this is... my incident supposedly happened in a crowded cafeteria ... croweded with students and parents. Who in their right mind would shove a child in front of so many witnesses? It was actually a ridiculous claim. BUT, here's my point. If a child is going to be mistreated, it would be done where no one would be able to witness it. Where it's just the child against the adult.
Anyone who works in a school system, knows that touching a child in any manner is a no-no. I've had principals who actually cautioned us against hugging and other signs of affection. This sub must be STUPID or unqualified to have done such a horrible thing. I would expect nothing less than the sub being fired over this. BUT, teaching is the ONLY profession that I can think of that has a stupid thing called TENURE... I know in NJ it's almost impossible to fire a tenured teacher.
I'd find out everyone's version of the incident... your child's, the other students... the subs. An incident report should have been filed by someone in that school and if I'm correct, under the freedom of information act, you have a right to see a copy. Your lawyer can give you better info about this than I can. BUT, you are your child's advocate. YOU will always know your child better than anyone else who cares for him or teaches him. You are the expert when it comes to your child.
I'm rambling about this. And I'll think of more questions tomorrow. This whole thing bothers me so much because that SUB knew that he shouldn't have done that and did it anyway. He lost control and that should never ever happen when you're dealing with any child.
OK.. a few quick questions... How old is this sub and how many years has he been subbing?

From what his regular teacher told me, that morning the sub told her "I should not be here. I am too old to be in this class and I cant deal with 'these' kind of kids." So no, I dont think he was/is qualified to teach a ULD class. It is a class for kids with all kinds of learning disabilties as well as ADHD. I think only 1 other child is on meds though.
I've talked to everyone that the school will legally allow me to talk to and 2 teachers that could get fired if the school found I've talked to them. His teacher told me WAY more then she should of and I cant tell anyone in the school the things she's said. She told me that this sub is on the "no call" list. Which here means that there has been a problem with him before. It doesn't mean anything like this has happened but SOMETHING has happened to make them put him on that list. I dont know why he was called and I still dont understand why 3 adults knew about this Friday during school and told NO ONE. I thought all school staff were mandated reporters but maybe not when it comes to one of their own.
