"Re-Leaf", our local marijuana club

Oct 30, 2006 00:02

lockalsh and I own a house a few doors down from the “Re-Leaf Herbal Center”. The "medical marijuana club" is in the middle of our residential district within two blocks of an elementary school, a high school, a day care center, the Mission Recreation Center, and a recreational park with tennis and soccer courts. Since the club opened our garage door and planter have been vandalized several times, our housemates' car has been broken into three times and vandalized several more times, and a stolen car was abandoned in front of our house. The club’s guests and customers either double-park on our street or park in our driveways and on our sidewalks, blocking us in. Ironically, the guy who runs the corner store at the end of the same block can't get a license to sell beer because his store, my house, and "Re-Leaf" are within one block of an elementary school, a high school, a day care center, and a park.

What's frustrating is that although I don't enjoy using it I support responsible marijuana use, both medical and non. The problem is that our neighbors' customers aren't responsible. The problem is that it's a high-volume commercial enterprise in a residential district, and the San Francisco "pot club" laws prohibit them operating in residential districts. Just like they would prohibit a pet store or Blockbuster Video from opening in the same space.

...which brings me to my main annoyance. Recently the city of San Francisco granted "Re-Leaf" a temporary "grandfathering" permit to continue to operate until this summer. "Re-Leaf" is buying time to try to get permanently "grandfathered" at their current location. The problem with "grandfathering" Re-Leaf is that Re-leaf was never legal. You can provide "grandfather" exemption to a previously-legal business made illegal by a new law, but you can't "grandfather" a business that has always been illegal from the day it opened.
