I'm sitting here listening to the rain and staring at the window. Watching the drops hit each individual leaf on the trees... Ahhh... Rain... So peaceful. I was listening so intentively till I heard an awful noise. Cat's having sex somewhere in my backyard. Hi there! I noticed that you are using a background image that was made especially for the All Things Kawaii site. Since this was not intended as something made for sharing, and you didn't ask permission to use it, my request is that you delete it and replace it with something else. I think the original creator of the graphic would be very disappointed to know that you just took it like this, as I'm sure you would if someone had done the same to your own images. I'll hold off on notifying her for the time being of course, and hope that we can resolve this on our own.

Sorry for posting this here, but you don't have an email address listed, so this was my only choice.

Well, it's not consider 'stealing' since, she's not using it for profit or marketing. But, only for her own personal look and style and it's not like that person doesn't still have it.

She's not going around telling people, "HEY! I made this image! isn't it need?!"

oh and i'm pretty sure, you're the clean slate that wanders through the internet not downloading mp3s, videos, and pictures. *sarcasm*

Actually, it is considered stealing, even if not used for profit or marketing. Your argument about this would not hold up in a court of law, because copyright applies even if the design is not sold. And it does apply in this case, because it is not automatically considered in the public domain, just because it was posted to the Internet.

She may not be claiming credit for this image, but she's also not giving anyone proper credit for it. People coming to this journal may think that she made the image, since there is no credit given anywhere.

When it comes to using other people's images, I definitely post a link somewhere on the page or site I use it on. I don't have a tendency to use images that are not offered up for me to use though, so this case isn't really the same. It was not an image offered for free use, like on a free graphics site, and no permission was requested to use it.

The way you linked to the Sanrio image on allthingskawaii was considered stealing bandwidth, and this page explains it:

Your use of the background on your journal though is against copyright. There are plenty of sources about this, so just searching for "copyright" will help.

Actually, it's *my* graphic, created by a friend, so it's not like I'm just a random person jumping in here. And to clarify, she's not stealing bandwidth with this one, but stealing a copyrighted image. She did steal bandwidth with a post on another community though. Regardless of the sizes, the point is to not steal other people's images!

As I stated earlier, this person doesn't have their email address listed anywhere, so how could I have found it? I would have rather done it that way, but I didn't have that information.

I'm sorry, but where's your copyright on the image? I didn't see the original one, so if you posted your copyright directly on it or have documentation elsewhere, now would be a good time to show it.

If your name, organization, etc. was on it in the first place, then aren't you receiving credit, anyway?

The image didn't have a copyright on it, but I could have produced screenshots showing the copyright on my own site. I also could have brought in the person who created the image originally, but fortunately, we didn't have to get to that level.

I think it's resolved for all parties involved though, so it doesn't really need to be dragged on further. This is my last reply. Thanks!

I know that you didn't get permission because All Things Kawaii is my site, and I haven't gotten any email from you asking to use it. The image was made for me by an online friend, so I think I do have a right to jump in here.

I posted here because you don't have an email address listed. If you did, I would have emailed you about this.

Fine I will remove it. I don't see why anyone would really care. It's a tiny little picture that probably took a few minutes to make! And it is cute! But, it's not even a dollar to me. And I don't see why it would be worth that much to anyone else. So it can easily be deleted!
