Your right to breathe is a part of your right to live. Breathing clean air is a luxury, and not necessary for continued living. That's the difference.

it's certainly significant to continued health. I don't give a fuck what Penn had to say on the matter- second-hand smoke is real, and it's fucking unpleasant.

He didn't say it wasn't real, he said the health effects of it were insignificant at best. Second-hand smoke is the equivalent of someone blaring loud rap music; It offends a sense, but it's not going to fucking kill you.
