Guy Game Draws Lawsuit
Honest officer, she said she was 18.
By Garnett Lee
The Cox News Service today reports that a young woman filed suit Monday in Austin, TX. against several parties involved with the Guy Game. It alleges that footage taken of her topless during Spring Break revelry at South Padre Island was included without her legal consent. Those named as defendants include not only developer Topheavy Studios and publisher Gathering of Developers, Inc. but both Sony and Microsoft on whose consoles the game has been available since this summer.
A further complication is the basis for the claim. The girl was 17 years old at the time of the filming. This invalidates any consent she may have given and calls into the question the legality of the material in general. The teen's lawyer, Jeff McClendon, has not released any comments. The suit itself, however, states that she did not give a "valid or enforceable consent or release" for her photo to be used. It goes on to add that the, "Plaintiff is still a teenager and wishes to attend college, develop her career and be active in her community and church."
A judge granted a temporary restraining order prohibiting any sales of the games which used the girl's image, voice and name. The girl has asked that that any copies of The Guy Game with her in it be pulled from distribution. Should she prevail it calls into question whether anyone holding a copy would be guilty of possession of underage pornography.
this is just another reason im glad i never recieved this game. stupid stupid people.
