I've seen this image used around the web a bit. I even know of someone who stole the image and claimed it as his own work to enter it in a T-Shirt contest, and won. Ass.
It is a derivative work of the Linux 2.0 Penguin by Larry Ewing. I "pirated" (hahaha) the image back in 1999 when I was first learning how to use The GIMP (a Photoshop-like, free, open-source graphics program, and the program I use to produce my comics).
Technically, this image is free for all to use, as long as credit is given to the original image creator, and to me for the modifications. This is equivalent to the following Creative Commons License, in my estimation:
