Studying to get my license, applying to be a physical therapist, preparing to make my first major move, ending my last clinical, AND dealing with identiy theft all at once may be the end of me. ok, this whole thing is pissing me off so i looked up a little on the duty time warner owed and owes to you:
All persons have a duty to exercise reasonable care as to third parties who may be foreseeably endangered by their conduct. In the context of claims arising from identity theft, this duty takes two general forms-taking precautions to safeguard the plaintiff's personal information from identity theft, and ensuring that derogatory information arising from an identity theft that has already occurred does not continue to be attributed to the plaintiff.
so time warner owed you a duty to take precautions to make sure people weren't setting up accounts in your name and they failed to take simple, reasonable precautions to prevent your harm- something as simple as checking the driver's license, which they always have done when i set up cable with other companies. they could have prevented this harm to you with very little effort. potentially, if they want to keep fucking around here, not only are they liable to you for the cost of these bills (which they better just fucking drop), they could also be liable to you for all the cost and hassle you've endured due to all this.
next time you talk to them i would be insistent that they drop these charges and put a hold in place so no one else can open accounts in your name. i'm sure it's hard to get any real point across when you are talking to idiots on the help line, and since the supervisors are of no use, insist on talking to their legal department- all companies like that have them and once they hear the details of this crap they will drop it i'm sure. they will also make sure this STOPS happening to you.

Yeah, it all such bullshit. I had to get copies of the bills for the police report. It is so surreal to see bills with my name on it at an address I never lived at and services I never received. These fuckers paid some on this account, because the last bill was $1,946 and now $396 is owed. They had to have some phone number to this account and if people paid on it, can't they go back to see whose name was on the fucking check? Ugh.

They sent me all this shit to fill out, a different set of things than the AT&T debacle. I have to have a police report for them to drop my charges. And getting in touch with someone for that has been so awful. I move in two weeks, what am i suppose to do? No clue how people got my name and info. If they find the person who did this can i sue them? and if so would i have to foot the legal bills?

My dad says places have to keep copies of leases for ten years, do you know if this is true? Also, if i needed could I get a court order for him to find it? I have a feeling this guy is just busy and not doing it.

I have a fraud alert on my credit, but i may need to put a full flege freeze. Worried what might show up three months from now.
